By accessing and using CloudK ("Service"), operated by CloudK LLC ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

CloudK provides AWS cost optimization recommendations and analysis. Our service:

• Analyzes your AWS usage and spending patterns
• Provides recommendations for cost optimization
• Offers tools to implement optimization strategies
• Does NOT automatically modify or delete AWS resources without explicit user approval

3. User Responsibilities

You are responsible for:

• Providing accurate AWS credentials with appropriate permissions
• Reviewing and approving all optimization recommendations before implementation
• Maintaining backups of critical AWS resources
• Understanding the impact of optimization actions on your AWS infrastructure
• Ensuring compliance with AWS Terms of Service

4. Limitation of Liability

• Any loss of data, service interruption, or damage to your AWS resources
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, or business opportunities
• Actions taken based on our recommendations
• Errors or interruptions in AWS services

Our total liability shall not exceed the amount you paid for the Service in the last 12 months.

5. Data Security & Privacy

We implement industry-standard security measures including:

• AES-256 encryption for AWS credentials
• Secure TLS connections for all data transfers
• Regular security audits and updates
• Strict access controls and monitoring

6. Subscription & Billing

Subscription terms:

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• 14-day free trial available for new users
• Prices may change with 30 days notice
• You may cancel your subscription at any time

7. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to breach or circumvent our security measures
• Share your account credentials with others
• Use the Service to damage or disrupt AWS services
• Reverse engineer or attempt to extract source code

8. Intellectual Property

All content, features, and functionality of CloudK are owned by CloudK LLC and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Delaware.
